Terms of Service

1. The Service

JustYourMenu lets business owners, or anyone who needs the service, to create and manage a digital menu, accessible to their customers via a QR code and a public web page. We provide the tools to build, edit, and publish menu content; we do not review, endorse, or take responsibility for the accuracy of any menu content you publish. The Service does not support in-menu purchases or payments between you and your customers.

2. Accounts

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service.

3. Subscriptions, Trials & Billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Paid plans are billed on a recurring monthly basis through our payment processor, Paddle. By subscribing, you authorize recurring charges to your payment method until you cancel.

New accounts are eligible for a free 7-day trial. No credit card is required to start the trial. At the end of the trial, unless you subscribe to a paid plan, your account will become inactive and all services will be paused. Trial eligibility and duration are subject to change.

Refunds are available for the first paid subscription within 30 days of the initial charge; processing is handled by Paddle. After that period (or for subsequent subscriptions), fees are non-refundable except where required by law.

You may cancel at any time. Cancellation takes effect at the end of your current billing period, and you will retain access to the services until that period ends.

If your account does not have an active paid subscription (including where a free trial has ended without a paid plan being started) for more than 30 consecutive days, we reserve the right to permanently delete your menus and Your Content associated with them. Since menus on an account without an active subscription are already hidden from public view, this removal simply makes that inactive state permanent. You can prevent this by subscribing to a paid plan before the 30-day period elapses. This is separate from, and in addition to, the account deletion process described in Section 9.

Where a plan is advertised as offering an "unlimited" amount of a feature (such as categories or menu items), this means an amount that is reasonable for, and consistent with, the normal operation of a single business's digital menu - not unlimited in a literal or unrestricted sense. It does not permit uses such as bulk data storage, hosting content unrelated to an actual menu, or usage patterns significantly outside typical use by a business of your type and size. If we determine, acting reasonably, that your use of an "unlimited" feature is excessive or abusive, we may contact you to discuss it and, if the issue is not resolved, limit or suspend the account to prevent further abuse.

4. Your Content

"Your Content" means the menu items, descriptions, prices, images, allergens, and other material you upload or enter into the Service. You retain all ownership rights to Your Content.

By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and transmit Your Content solely for the purpose of operating and providing the Service to you and the customers who view your public menu page. You are solely responsible for Your Content and for having the rights necessary to publish it, including allergen, pricing, and nutritional accuracy where applicable under local law.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Upload content that is fraudulent, defamatory, infringing, or that you do not have the right to publish
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its infrastructure
• Use automated means to scrape or extract data from the Service, other than the public menu pages as intended
• Resell or sublicense access to the Service without our written consent

6. Intellectual Property

The Service, including its software, design, branding, and underlying technology (excluding Your Content), is owned by JustYourMenu and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding beyond what's needed to use the Service as intended.

7. Service Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

8. Limitation of Liability

To the maximum extent permitted by law, JustYourMenu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 2 months preceding the claim.

9. Termination

You may stop using the Service and request removal of your account at any time. We may suspend or terminate your access if you violate these Terms, engage in fraudulent or harmful activity, or fail to pay applicable fees.

Upon account deletion, your right to use the Service ceases immediately and we permanently remove Your Content from our production database. We do not restore deleted accounts or data upon request. Residual copies may remain in automated backups for a short period and are used only for disaster recovery.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by email or an in-app notice, before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Serbia, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Serbia.
